MarinaNet is a maritime data management platform designed to streamline emissions reporting, compliance, and operational data handling. By using this platform, you acknowledge and agree to abide by the terms outlined below.
Acceptance of Terms
By accessing or using MarinaNet, you confirm your agreement to these Terms of Use and our Privacy Policy. If you do not agree to these terms, you should discontinue using the platform.
User Responsibilities
As a user of MarinaNet, you are responsible for:
- Providing accurate, current, and complete information during account registration.
- Ensuring the data uploaded to the platform complies with all applicable maritime laws and regulations.
- Maintaining the confidentiality of your account credentials and restricting unauthorized access to your account.
You agree not to:
- Use the platform for unlawful or unauthorized purposes.
- Reverse-engineer, decompile, or tamper with the platform in any way.
- Submit false, misleading, or inaccurate data.
Account Security
You are responsible for all activities that occur under your MarinaNet account. You agree to promptly notify MarinaChain of any unauthorized access or security breach.
Permitted and Prohibited Use
- Permitted Use: You may use MarinaNet to collect, process, and report maritime data related to compliance, fleet operations, and emissions management.
- Prohibited Use: You may not use the platform to engage in illegal activities, submit unauthorized data, or misuse the platform in any way that violates applicable laws, regulations, or these Terms.
Data Collection and Use
By using MarinaNet, you consent to MarinaChain collecting and processing the data you upload or submit to the platform. The data will be used for:
- Generating compliance reports, fleet analysis, and improving platform services.
- Enhancing the platform through analysis of anonymized and aggregated data, including navigation information.
You retain ownership of the data you upload. MarinaChain may use aggregated and anonymized data, including navigation information, for research, analytics, and to enhance its offerings. Such data does not personally identify you.
Minimal Data Collection and Deletion Upon Withdrawal
In compliance with applicable regulations, including Korean law, we collect only the minimum personal information necessary for providing our services. Upon your withdrawal from the platform, we will delete your personal data in a manner that cannot be recovered, unless retention is required by law.
Consent for Anonymised Data Use
By agreeing to these Terms, you consent to MarinaChain retaining and using anonymised and aggregated navigation information after your withdrawal from the platform, for the purposes of service improvement and development.
Subscription, Fees, and Payment Terms
- Subscription: MarinaNet operates on a subscription basis. By registering for a paid account, you agree to the subscription fees applicable to your chosen plan.
- Billing: Fees will be billed at the start of each billing cycle. If payment is not received, MarinaChain reserves the right to suspend or terminate your access to the platform.
- Refunds: Refund policies, if any, will be outlined in your subscription agreement or discussed during your onboarding process.
Intellectual Property
All content and software related to MarinaNet are the intellectual property of MarinaChain or its licensors. You may not modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell any content from the platform without prior written consent from MarinaChain.
Liability Disclaimer
MarinaNet is provided on an “as-is” and “as-available” basis. MarinaChain makes no warranties or guarantees regarding the accuracy, reliability, or completeness of data processed or reports generated by the platform.
To the fullest extent permitted by law, MarinaChain disclaims all warranties, express or implied, including but not limited to implied warranties of merchantability and fitness for a particular purpose. MarinaChain will not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from your use of the platform.
Indemnification
You agree to indemnify, defend, and hold harmless MarinaChain, its affiliates, officers, directors, employees, agents, and licensors from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from:
- Your use or misuse of the platform.
- Any violation of these Terms of Use.
- Your violation of any third-party rights, including intellectual property or privacy rights.
Termination
MarinaChain reserves the right to terminate or suspend your account at its sole discretion if you violate any terms of this agreement or applicable laws. In the event of termination, you will no longer have access to any data or reports generated on the platform. Upon termination, your personal data will be deleted in accordance with our Privacy Policy.
Governing Law
These Terms of Use shall be governed by and construed in accordance with the laws of Singapore, without regard to its conflict of law provisions. Any disputes arising from the use of MarinaNet will be subject to the exclusive jurisdiction of the courts in Singapore.
Amendments
MarinaChain reserves the right to modify or amend these Terms of Use at any time. Any changes will be communicated to users through the platform or via email, and the "Effective Date" at the top will be updated. Continued use of the platform after changes are made constitutes acceptance of the revised terms.
Severability
If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect.
Entire Agreement
These Terms of Use, along with the Privacy Policy, constitute the entire agreement between you and MarinaChain regarding the use of MarinaNet.
