Terms of Use

By accessing or using the Platform, you confirm your agreement to these Terms of Service and the Privacy Policy. If you do not agree to these terms, please discontinue use of the Platform.

As a user of the Platform, you are responsible for:

• Providing accurate, current, and complete information when registering an account.
• Ensuring that any data you upload to the Platform complies with all applicable maritime laws and regulations.
• Keeping your account credentials confidential and restricting unauthorized access to your account.

You agree not to:

• Use the Platform for any unlawful or unauthorized purpose.
• Reverse-engineer, decompile, or otherwise tamper with the Platform in any way.
• Submit false, misleading, or inaccurate data.

You are responsible for all activity that occurs under your Platform account. You agree to promptly notify MarinaChain of any unauthorized access or security breach.

• Permitted use: You may use the Platform to collect, process, analyze, and report maritime data related to compliance, fleet operations, market analysis, and emissions management.
• Prohibited use: You may not use the Platform to engage in unlawful activity, submit unauthorized data, or otherwise misuse the Platform in violation of applicable laws, regulations, or these Terms.

Market analysis, asset valuations, forecasts, and other outputs generated by the Platform are reference indicators produced by AI models and should not be relied upon as the sole basis for investment or operational decisions.

Due to the nature of AI models, discrepancies may occur between the analysis results and actual market conditions; because results are based on historical data, they do not guarantee future performance.

Responsibility for all outcomes and losses resulting from final decisions rests with the user, and the Company shall not be held legally liable under any circumstances.

By using the Platform, you agree that MarinaChain may collect and process data that you upload or submit to the Platform. This data is used for the following purposes:

• Generating compliance reports, fleet/market analysis, and improving Platform services.
• Analyzing anonymized and aggregated data, including voyage information, for the purpose of improving our own services.

You retain ownership of the data you upload. MarinaChain may use aggregated and anonymized data, including voyage information, solely for the purpose of improving its own services. Some of this processing may be carried out using third-party AI models such as Google Gemini and OpenAI, and is subject to those providers’ data retention policies (a minimal-retention principle). See Section 4-1, “Service-Specific Addendum,” of the Privacy Policy for the specific processor used by each service.

In compliance with applicable regulations, including those of Korea, the Company collects only the minimum personal information necessary to provide the service. If you withdraw from the Platform, your personal data will be deleted in a manner that it cannot be recovered, unless retention is required by law.

By agreeing to these Terms, you consent to MarinaChain retaining and using anonymized, aggregated voyage information for the purpose of improving its own services, even after you have withdrawn from the Platform.

• Subscription: The Platform may operate under separate pricing plans (including free and paid tiers) for each service. By registering for a paid account, you agree to the subscription fees applicable to the pricing plan of the selected service.
• Billing: Fees are charged at the start of each billing cycle. If payment is not made, MarinaChain reserves the right to suspend or terminate access to the relevant service.
• Refunds: Where a refund policy applies, it will be specified in the subscription agreement or discussed during onboarding.

All content and software related to the Platform are the intellectual property of MarinaChain or its licensors. You may not modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell any content on the Platform without MarinaChain’s prior written consent.

The Platform is provided “as is” and “as-available.” MarinaChain does not warrant or guarantee the accuracy, reliability, or completeness of any data processed, AI analysis results, or reports generated on the Platform.

To the fullest extent permitted by law, MarinaChain disclaims all warranties, whether express or implied, including implied warranties of merchantability and fitness for a particular purpose. MarinaChain shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from use of the Platform.

You agree to indemnify, defend, and hold harmless MarinaChain, its affiliates, officers, directors, employees, agents, and licensors from any claims, liabilities, damages, losses, costs, expenses, or fees arising from:

• Your use or misuse of the Platform.
• Your violation of these Terms.
• Your violation of any third party’s rights, including intellectual property or privacy rights.

MarinaChain reserves the right, at its sole discretion, to terminate or suspend your account for breach of these Terms or applicable law. Upon termination, you will no longer have access to data or reports generated on the Platform. Following termination, personal data will be deleted in accordance with the Privacy Policy.

These Terms are governed by and construed in accordance with the laws of Singapore, without regard to conflict-of-law principles. All disputes arising from use of the Platform are subject to the exclusive jurisdiction of the courts of Singapore.

MarinaChain reserves the right to modify or change these Terms at any time. Changes will be communicated to users via the Platform or by email, and the “Effective Date” at the top of this document will be updated. Continued use of the Platform after such changes constitutes agreement to the revised Terms.

If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect.

These Terms, together with the Privacy Policy, constitute the entire agreement between you and MarinaChain regarding use of the Platform.
